Definitions

“We” are Black & White Music Limited (“we”, “our” and “us”) and we operate under the names of Black & White Music, Heavy Pop, Are You Listening? Festival and Down At The Abbey festival.

“Customer” (“you”, “your”) means a person that purchases a ticket for one of our events, and/or signs up to our mailing list, and/or provides feedback on a survey response.

 “Ticketing Agency” is the company where you purchased your ticket from.  The ticketing agencies we use may include, but are not limited to:  

  • Music Glue
  • We Got Tickets
  • Gigantic
  • Reading Arts
  • Ticketweb
  • Dice
  • See Tickets

These companies should have their own Privacy Agreements and compliances with GDPR/ Data Protection and Data Handling laws.

”Personal Data” – defined as information that can be associated with or which relates to a person and/or could be used to identify a person

Introduction

We are a live music/events promoter putting on events in the South East of England, as well as the annual Are You Listening? Festival and Down At The Abbey festival, in Reading.

We take your privacy very seriously and this Privacy Policy is intended to help you better understand how we collect, use and store your Personal Data. We only use this information for our event ticket lists (which you have purchased a ticket for) or to tell you about future shows we think you might like (provided you have given us your consent to do so).

We will never sell on your Personal Data to third parties and if you choose to consent to receiving marketing emails from us you will be able to unsubscribe at any time.

Personal Data that we collect

As a Customer buying tickets for our events we will collect Personal Data from you (passed to us from the Ticketing Agency you purchased your ticket through) to identify that you have indeed bought a ticket for the event and you are the named ticket holder, if applicable. This data may include Full Name, Address, Email Address, last four digits of Credit Card etc.

As a Customer signing up to our mailing list (either by opt-in consent via the Ticket Agency, or by directly signing up using a form on our website) we will collect the information that you provide us – Full Name, Email Address, City and any preferences that you select.

As a Customer responding to one of our surveys, we will collect the information that you provide us – e.g email address, age bracket, and any other feedback you provide, in order that we can take on board customer comments to develop the event.

How we use your Personal Data

We collect and use the Personal Data we collect in a manner that is consistent with this Privacy Policy. We may use the Personal Data as follows:

Specific Reason

If you provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided. For instance, if you contact us by e-mail, we will use the Personal Data you provide to answer your question or resolve your problem and will respond to the email address from which the contact came.

Ticketing

We will use your Personal Data to compile ticket lists for our events, to verify the identity of the ticket holders.  This will be compiled digitally and then printed for use by our box office staff at the event.

Marketing Communications

Our Mailing List is hosted by Mail Chimp. You will only receive marketing emails from us if you have opted in to receive them. We will make sure it is clear when you can make these choices, for example, we have boxes you need to select if you want to receive marketing. You will always be able to unsubscribe from any marketing emails from us at any time by clicking “unsubscribe” in the email or by contacting info@heavypop.co.uk

Other Purposes

If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time the Personal Data is collected or we will obtain your consent subsequent to such collection but prior to such use.

How we disclose and transfer your Personal Data

We will never sell on your Personal Data to third parties.  There are, however, certain circumstances in which we may disclose, transfer or share your Personal Data with certain third parties without further notice to you, as set forth below.

Agents, Consultants and Service Providers

We may share your Personal Data with email providers, backup and disaster recovery service providers and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.

Legal Requirements

We may disclose your Personal Data if required to do so by law in order to (for example) respond to a request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, or (c) protect against legal liability.

How we store your Personal Data

We may store Personal Data itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable organisational and technological and security measures to protect the Personal Data collected via the Services from loss, misuse, unauthorised use, access, inadvertent disclosure, alteration and destruction.

However, no network, server, database or Internet or e-mail transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any Personal Data.

How you can access, update, correct or delete Personal Data

You can request access to some of your Personal Data being stored by us. You can also ask us to correct, update or delete any inaccurate Personal Data that we hold or process.

You may also exercise these rights by contacting us directly by email via info@heavypop.co.uk or at the address specified below.

You understand that even if we delete your Personal Data upon your request or pursuant to this Policy, your Personal Data may still be available on the Ticketing Agency’s records, unless you also contact them directly.

We will consider and respond to all requests in accordance with applicable law.

How long we retain your Personal Data

For Customers with tickets to an event, we retain your Personal Data up to three days after the show date, after which any digital or paper records will be destroyed, aside from that required for legal, tax or regulatory reasons or for legitimate and lawful business purposes.

For Customers signed up to our Mailing List, we will retain your data indefinitely until you ‘unsubscribe’ after which your data will be immediately deleted.

For Customers who have completed one of our surveys, your data will be retained indefinitely unless you contact us to have it removed from the survey.

We will take reasonable steps to work with you to attempt to resolve your complaint.

Purchasing Tickets

We use a number of ticketing companies/ticket agencies to sell tickets to our shows. These ticketing companies collect and record your personal information as part of the ticket purchase process, which you agree to as part of their terms and conditions when purchasing tickets through them.

Once you’ve purchased a ticket, we are sent your name, address, email and ticket number for use by us or the relevant venue staff as part of the Ticket List for the show. This is sent securely by email, and is printed to allow letting you in to show. After each show we destroy the digital and physical copy of your personal info.

Newsletters

We use Mailchimp to create and send newsletters telling you about upcoming shows we think you will like. We use Mailchimp to collect your name, email address and explicit consent to receiving our emails, which they store securely online. No physical copy of this data is kept anywhere.
